How do I request the police report or accident report?

The New York State Traffic and Safety Law requires all the involved drivers and the police to file an accident report with the DMV for any accident occurring in the state of New York which involves a personal injury or death.  The police accident report is helpful, and often critical, to your case in obtaining the money and benefits you deserve for your injuries. If you are in a New York car accident, contact the police immediately to investigate and file a report. You must file the report no more than 10 days after the accident. The DMV can suspend your driver’s license if you fail to report an accident.  The steps for obtaining a Nassau County police accident report will depend on which law enforcement agency investigated your case. Check the paperwork you were given after the accident to determine which precinct you should contact.

Information for requesting an accident report:

  • Accident reports are available from the New York Police Department for 30 days following the date of the accident. You may request a copy of the report at the precinct office nearest the accident scene. You will need to complete a REQUEST FOR COPY OF ACCIDENT RECORD [PD301-165] form and provide a payment of $10.00 in the form of check or money order, payable to “City of New York, Police Department.”
  • After 30 days, your report will no longer be available at the precinct office, and you should request a copy from the New York State Department of Motor Vehicles. You will need to submit a NYS DMV form MV-198C and pay a $20.00 fee.
  • If your accident occurred outside of Nassau County, you can determine the appropriate agency by calling police stations or precinct offices nearest to the accident scene. You can also call the New York State Police or the county sheriff’s office. You will need to provide information about your accident, including the date and location of the accident, and the names of drivers and passengers involved in the crash.
